DO your legacy plans address all five components of a true legacy: values and life lessons, personal possessions of emotional value, fulfilling final wishes and instructions, ownership of financial assets and real estate, and management succession?

HAVE you considered the end, including the possibility of: A spiritual advisor or counselor, hospice or other care at home, appropriate levels of medical care, or riding off into-the-sunset?

HAVE you drafted your Advance Directives to explicitly describe your wishes for care near the end, including: medical/health care directives, living wills, powers of attorney, wills, or estate plans?

Death is a natural part of life – for most of us, talking about it isn’t. Most people are uncomfortable talking, or even thinking, about what will happen when they or a loved one dies. Avoiding the topic doesn’t stop death from happening.
   Planning for pre-death issues and possibilities before the time actually comes will free both you and your loved ones to spend time doing the things that are really important during your last days. Other considerations and issues you may want to address, include: life-sustaining treatments, where to spend your last days, care of dependents – minor children, an elderly parent, or relatives, foster children or adults, or possibly a disabled friend or family member, and care of animals, either pets or livestock in your care.

A will is a document that describes the last wishes of an individual after his or her death, including how property should be distributed and who should manage the estate of the deceased person. A will’s primary functions can be divided into two categories: (1) those directing the distribution of the decedent’s estate and (2) those nominating individuals to represent the decedent and his or her estate.

The Personal Property Memorandum

The law in some states allow a person who has signed a will to use a separate document (Personal Property Memorandum) to direct who will receive certain pieces of tangible personal property after death. Such a list provides a great deal of flexibility without the need to constantly update a will.
